Welcome to Expozy. These Terms of Service ("Terms") govern your access to and use of the Expozy platform at expozy.io (the "Service"), operated by Expozy ("we," "our," or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You must be at least 16 years old to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You must verify your email address before accessing the full Service.
  • You must promptly notify us of any unauthorized use of your account.
  • One person or legal entity may not maintain more than one free account.

3. Service Description

Expozy is a social media marketing platform that allows you to:

  • Connect and manage multiple social media accounts
  • Schedule and publish content across social networks
  • Monitor and respond to messages via a unified inbox
  • Create and manage marketing campaigns
  • View analytics and performance metrics
  • Manage multiple brands from a single workspace

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right
  • Send spam, bulk unsolicited messages, or automated engagement
  • Distribute malware, viruses, or harmful content
  • Impersonate another person or entity
  • Scrape, mine, or extract data from the Service beyond normal use
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent rate limits, access controls, or security measures
  • Violate the terms of service of any connected social media platform
  • Publish content that is defamatory, obscene, hateful, or promotes violence

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Social Media Platform Compliance

You are responsible for complying with the terms of service of each social media platform you connect to Expozy. We act as a tool at your direction — we do not control or take responsibility for the content you publish. You acknowledge that:

  • Social media platforms may change their APIs, terms, or rate limits at any time
  • We cannot guarantee uninterrupted access to any third-party platform
  • Content published through Expozy is subject to the connected platform's policies
  • Platform-imposed restrictions (e.g., post limits, content moderation) apply

6. Your Content

You retain all rights to the content you create, upload, or publish through the Service. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service. We do not claim ownership of your content.

You are solely responsible for your content and the consequences of publishing it. You represent that you have the right to publish any content you submit through the Service.

7. Subscription & Billing

7.1 Plans

The Service offers free and paid subscription plans. Features and limits vary by plan. Plan details are available on our pricing page.

7.2 Payment

Paid plans are billed monthly or annually in advance via Stripe. All fees are stated in US Dollars and are non-refundable except as required by law or as stated in our refund policy.

7.3 Plan Changes

You may upgrade, downgrade, or cancel your plan at any time. Downgrades take effect at the end of the current billing period. If you downgrade below your current usage (e.g., more brands than the lower plan allows), you may need to remove brands or accounts to comply.

7.4 Price Changes

We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance of the new pricing.

8. Free Plan Limitations

The free plan is provided "as is" with limited features. We reserve the right to modify free plan limits at any time. Free accounts that remain inactive for 12 months may be scheduled for deletion after notice.

9. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Expozy and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

10. API & Integrations

If you access our API (available on Agency plans), you agree to:

  • Respect rate limits and usage guidelines
  • Not use the API to build a competing service
  • Keep your API keys confidential
  • Comply with these Terms in your API usage

11. Privacy & Data Protection

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPOZY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Expozy and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

15. Termination

Either party may terminate these Terms at any time. You may terminate by deleting your account. We may terminate or suspend your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion, after which it will be permanently removed.

16. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after modifications constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

18. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Expozy.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our consent.
